1. Introduction

Welcome to GiveGetFunds, a crowdfunding platform operated by [COMPANY_NAME]. These Terms of Service govern your use of our Platform. By using GiveGetFunds, you agree to these Terms.

IF YOU DO NOT AGREE, DO NOT USE THIS PLATFORM.

2. Eligibility

A) All Users:

• Must be at least 18 years of age
• Must have legal capacity to enter binding contracts
• Must not be located in sanctioned countries or territories (as per OFAC, UN, or applicable sanctions lists)

B) Campaign Owners (additional requirements):

• Must provide a valid payment account (PayPal, Stripe, or crypto wallet) before publishing a campaign
• Organizations may create campaigns subject to additional requirements upon request

C) Geographic Restrictions:

• Services are not available where prohibited by local law or international sanctions
• It is your responsibility to ensure compliance with your local laws before using this Platform

3. Platform Function

GiveGetFunds is a platform only. We:

• Provide technology to connect Campaign Owners with Donors
• Does NOT hold, store, or manage donor funds at any point. PayPal and Stripe donations flow directly to Campaign Owners through those payment providers. Cryptocurrency donations are sent directly from the donor's wallet to the Campaign Owner's wallet via the blockchain network — GiveGetFunds has no access to or control over cryptocurrency transactions. Platform service fees are collected separately by payment processors on our behalf.
• Does NOT proactively verify the accuracy of Campaign information prior to publication. However, GiveGetFunds reserves the right to investigate any Campaign upon receiving a report or complaint, and to take appropriate action including suspension or removal of the Campaign.
• Does NOT guarantee that any Campaign will achieve its goals
• Acts solely as a technology intermediary facilitating connections between Donors and Campaign Owners. GiveGetFunds is not a principal party to the donation transaction itself. The collection of platform service fees represents compensation for technology services rendered, and does not constitute participation in, control of, or liability for the underlying donation transaction between Donors and Campaign Owners.
• Provides a messaging feature that allows Campaign Owners to send messages to Donors who have contributed to their Campaign. These messages are delivered to the email address provided by the Donor at the time of donation. GiveGetFunds acts solely as a delivery channel for these messages and is not responsible for their content. Campaign Owners are solely responsible for ensuring their messages comply with applicable laws including anti-spam regulations.

All donations go directly from Donors to Campaign Owners through third-party payment providers (PayPal, Stripe, cryptocurrency wallets).

4. Campaign Creation Rules

Prohibited Campaign Content:

• False, misleading, or deceptive information
• Illegal activities or content that violates applicable laws
• Fraud, scams, or pyramid schemes
• Weapons, drugs, or illegal substances
• Hate speech, violence, or discrimination
• Sexually explicit or inappropriate content
• Child exploitation or abuse
• Money laundering or terrorist financing

Campaign Visibility Options: Campaign Owners may choose to make their Campaign publicly visible on the Platform or set it as a Private Campaign. Private Campaigns are not displayed on the Platform and are accessible only to individuals who possess the direct Campaign link. GiveGetFunds does not guarantee the confidentiality of Private Campaigns and is not responsible for any unauthorized sharing of Campaign links by third parties. All Terms of Service apply equally to both public and private Campaigns.

Campaign Review: Campaigns are published immediately upon creation. GiveGetFunds reserves the right to suspend, remove, or modify any Campaign found to violate these Terms, and to report any illegal activity to the relevant authorities without prior notice.

4a. Reel Campaigns — Additional Terms

The following additional terms apply specifically to Reel Campaigns and supplement the general Terms of Service. By creating a Reel Campaign, you accept these terms in full.

4a.1 Definition: A "Reel Campaign" is a fundraising campaign on the GiveGetFunds Platform that incorporates a short-form vertical video uploaded directly by the Campaign Owner. GiveGetFunds hosts and serves the video as a storage and distribution service provider within the meaning of Article 6 of Regulation (EU) 2022/2065 (Digital Services Act). GiveGetFunds does not produce, endorse, edit, or take editorial responsibility for any uploaded video content.

4a.2 Ownership and Responsibility of Video Content: You represent and warrant that: (i) you are the legal owner of all content in the video or hold all necessary licences and rights to upload, store, and distribute it; (ii) the video does not infringe any third-party intellectual property rights, including copyright, related rights, trademark, or trade secrets; (iii) the video does not contain the image, voice, likeness, or personal data of any individual without their explicit, specific, and freely given consent in accordance with GDPR (Regulation (EU) 2016/679); (iv) the video content is truthful, accurate, and not misleading in accordance with Directive 2005/29/EC on unfair commercial practices and Directive 2006/114/EC on misleading advertising; (v) the video complies with all applicable national and European Union laws, including Belgian law; (vi) the video has not been generated or materially altered using artificial intelligence in a way that could mislead a reasonable viewer, without clear disclosure.

4a.3 Technical Requirements and Upload Standards: Accepted formats are MP4, MOV, and WebM. Maximum file size is 500 MB. Maximum duration is 3 minutes (180 seconds). The recommended aspect ratio is 9:16 (portrait). Videos that fail technical validation will be automatically rejected at the point of upload. GiveGetFunds does not guarantee video availability in the event of server maintenance, force majeure, or technical failure beyond its reasonable control.

4a.4 Content Moderation and Removal (DSA Compliance): GiveGetFunds implements good-faith content moderation in accordance with its obligations as a hosting service provider under the Digital Services Act (Regulation (EU) 2022/2065). GiveGetFunds reserves the right to restrict, suspend, or permanently remove any uploaded video that violates these Terms or applicable law — including but not limited to content that is unlawful, fraudulent, misleading, or infringes third-party rights. Where required by law, the Campaign Owner will be notified of the removal and provided with a statement of reasons. Campaign Owners may contest removal decisions through the dispute mechanism described in Section 12.

4a.5 No Performance Guarantee: GiveGetFunds makes no representations or warranties, express or implied, regarding the fundraising results of any Reel Campaign. Campaign outcomes depend exclusively on the Campaign Owner's content quality, outreach, and donor decisions. Any implication that video-based campaigns guarantee higher donations would constitute a misleading commercial practice under EU law and is explicitly disclaimed.

4a.6 Prohibited Video Content: In addition to the general prohibited content listed in Section 4, video content in Reel Campaigns must not contain: unsolicited commercial communications (spam); content targeting minors without verifiable parental consent in accordance with applicable law; hidden advertising, product placement, or undisclosed sponsored content contrary to Directive 2005/29/EC and Directive 2018/1808/EU (AVMS Directive); content that violates any individual's rights to privacy, dignity, honour, or image rights under applicable law; deepfakes or AI-generated content that misrepresents the identity or statements of real individuals without disclosure; or content that has previously been removed by GiveGetFunds or any competent authority for violating applicable law.

4a.7 Intellectual Property of Uploaded Content: You retain full ownership of all video content you upload. By uploading a video, you grant GiveGetFunds a non-exclusive, royalty-free, worldwide licence to host, store, transmit, and display the video solely for the purpose of operating your Reel Campaign on the Platform. This licence terminates automatically when your campaign ends or your video is removed. GiveGetFunds will not use your video for any commercial purpose beyond campaign display without your prior written consent.

4a.8 Data Protection in Video Content: If your video contains personal data of third parties — including images, voices, or names — you are acting as a data controller in respect of that data under GDPR. You must ensure you have a lawful basis for processing such data and that data subjects have been informed in accordance with Articles 13–14 GDPR. GiveGetFunds processes video data as a data processor on your behalf; its processing is governed by the Data Processing Agreement incorporated by reference into these Terms.

4b. Standard Campaigns — Third-Party Video Links (YouTube / Vimeo)

4b.1 Nature of Embedded Content: Standard Campaigns on GiveGetFunds may include a link to a video hosted on a third-party platform — currently YouTube (operated by Google LLC) or Vimeo (operated by Vimeo, Inc.) — which is displayed to donors via an embedded iframe on the campaign page. GiveGetFunds does not host, store, transmit, or process the video content itself. The video is served entirely by the third-party platform directly to the donor's device. GiveGetFunds acts solely as an intermediary that facilitates the display of a hyperlink reference to externally hosted content.

4b.2 Responsibility of the Campaign Owner: By submitting a YouTube or Vimeo link to your campaign, you represent and warrant that: (i) the video does not infringe any third-party intellectual property rights, including copyright, related rights, trademarks, or trade secrets, under Directive 2001/29/EC (Copyright Directive), Directive (EU) 2019/790 (Digital Single Market Copyright Directive), or any applicable national law; (ii) you are either the original creator of the video content, or you hold a valid licence or authorisation from the rights holder to publicly display and embed the content in a fundraising context; (iii) the video content is accurate, truthful, and not misleading in relation to the fundraising campaign, in accordance with Directive 2005/29/EC on unfair commercial practices; (iv) the video does not contain personal data of any individual without their explicit consent, and you comply with all applicable GDPR obligations as data controller for any personal data appearing in the video; (v) the video does not constitute unlawful advertising, hidden commercial communication, or undisclosed sponsorship contrary to Directive 2018/1808/EU (Audiovisual Media Services Directive) or Directive 2006/114/EC.

4b.3 GiveGetFunds Has No Control Over Third-Party Content: GiveGetFunds does not review, moderate, edit, or take editorial responsibility for video content hosted on YouTube, Vimeo, or any other third-party platform. GiveGetFunds is not a hosting service provider for such content within the meaning of the Digital Services Act (Regulation (EU) 2022/2065) and cannot guarantee the continued availability, accuracy, or lawfulness of externally hosted videos. If a video is removed or made unavailable by the third-party platform, GiveGetFunds is not responsible for the resulting absence of video content on your campaign page.

4b.4 Third-Party Platform Terms and Privacy Policies: Embedding a YouTube video causes YouTube's embed player to load on the donor's device. This loading may result in YouTube collecting technical data — including IP address, browser information, and interaction data — from donors who view the campaign page, subject to YouTube's Privacy Policy and Google's Terms of Service. By embedding a YouTube video in your campaign, you acknowledge that donors will be subject to YouTube's data practices. GiveGetFunds strongly recommends using YouTube's Privacy-Enhanced Mode embed URL (youtube-nocookie.com) where possible to minimise third-party data collection from EU donors under GDPR. Similarly, Vimeo embeds are subject to Vimeo's Privacy Policy. GiveGetFunds is not responsible for any data processing carried out by third-party platforms as a result of embedded video content.

4b.5 Copyright and Intellectual Property — Specific Obligations: Under Directive (EU) 2019/790 on copyright in the Digital Single Market, embedding a hyperlink to publicly available video content does not in itself constitute a new communication to the public, provided the content was originally made freely available online by or with the consent of the rights holder. However, if the video you link to was uploaded without the rights holder's consent, embedding such content may constitute copyright infringement. You are solely responsible for verifying that the video you embed is lawfully available. GiveGetFunds reserves the right to remove embedded video links from campaign pages upon receipt of a valid notice of infringement from a rights holder, without prior notice to the Campaign Owner, in accordance with applicable EU law and the DSA.

4b.6 Prohibited Embedded Video Content: Campaign Owners may not embed videos that: contain content that is unlawful, fraudulent, misleading, or defamatory under Belgian law (Articles 1382–1383 of the Belgian Civil Code) or EU law; infringe the rights of any individual to privacy, dignity, honour, or image under applicable law; constitute hate speech, incitement to violence, or content prohibited under Belgian law of 30 July 1981 on the punishment of certain acts inspired by racism or xenophobia; are subject to any restraining order, injunction, or content removal decision issued by a competent authority; or promote competing fundraising platforms or direct donors away from GiveGetFunds in a manner that breaches these Terms.

4b.7 Removal of Embedded Links: GiveGetFunds reserves the right to remove or disable any embedded video link from a campaign page at its sole discretion if GiveGetFunds determines, in good faith, that the linked content violates these Terms, applicable EU or Belgian law, or the rights of any third party. Where required by applicable law, the Campaign Owner will be informed of such removal and provided with a brief statement of reasons. The Campaign Owner may submit a counter-notice through the dispute mechanism described in Section 12.

4b.8 No Warranty Regarding Video Availability: GiveGetFunds makes no warranty, express or implied, that embedded video links will remain available, functional, or accessible at any given time. Campaign Owners acknowledge that third-party video platforms may restrict, delete, or geo-block content at any time, and that such changes are outside GiveGetFunds's control. GiveGetFunds is not liable for any loss of donations or campaign performance attributable to the unavailability of embedded video content.

5. Fees & Payments

Platform Service Fees (added on top of the Donor's donation amount):

• PayPal/Stripe donations: 5% platform fee (paid by Donor)
• Cryptocurrency donations: 8% platform fee (paid by Donor)

Payment Gateway Fees — PayPal / Stripe: PayPal and Stripe charge their own processing fees which are deducted from the donation before reaching the Campaign Owner. These fees are determined solely by the payment providers and subject to change without notice. GiveGetFunds has no control over and is not responsible for payment provider fees.

Blockchain Gas Fees — Cryptocurrency: For cryptocurrency donations, blockchain network fees ("Gas Fees") are paid entirely by the Donor on top of their donation amount. They are NOT deducted from the Campaign Owner's received amount. Campaign Owners receive the full donation amount directly to their wallet. Gas Fees are determined by the respective blockchain network and GiveGetFunds has no control over them.

Examples (for illustrative purposes only):

PayPal / Stripe: Donor gives $100 → Platform fee 5% ($5) → Donor pays $105 → Payment gateway deducts processing fees → Campaign Owner receives approximately $96–$97.

Cryptocurrency: Donor gives $100 → Platform fee 8% ($8) → Blockchain network adds Gas Fees (~$0.10–$2.00 depending on network congestion) → Donor pays approximately $108.10–$110 → Campaign Owner receives $100 directly to their crypto wallet. Gas Fees are paid by the Donor to the blockchain network and are entirely outside GiveGetFunds' control.

Actual amounts may vary based on payment provider fees and network conditions at the time of transaction.

Cryptocurrency Network Fees (Gas Fees): For all cryptocurrency donations, blockchain network fees ("Gas Fees") are entirely borne by the Donor. These fees are determined by the respective blockchain network and may vary based on congestion. GiveGetFunds does not control, receive, or refund these fees.

Non-Refundable Fees: Platform service fees are non-refundable once a donation is processed, regardless of any subsequent dispute or chargeback filed through the payment provider.

6. Refunds & Disputes

No Platform Refunds: GiveGetFunds does not hold or control donated funds and will not issue refunds. Donations are transferred directly to Campaign Owners through third-party payment providers.

If you have concerns about a donation:

• Contact the Campaign Owner directly through the Platform messaging system to request a refund. Please note that Campaign Owners are solely responsible for any refund decisions regarding donations received. GiveGetFunds does not mediate or intervene in refund requests between Donors and Campaign Owners.
• File a dispute directly through your payment provider (PayPal, Stripe, or your credit card issuer) in accordance with their dispute resolution policies. Please note that chargebacks or disputes filed against GiveGetFunds may result in the suspension of your account pending investigation.
• Report any suspicious or fraudulent Campaign to us at [email protected] or through the Report button on the Campaign page. We will review all reports within a reasonable timeframe and take appropriate action in accordance with our Terms of Service.

Important Notice Regarding Cryptocurrency Donations: Cryptocurrency donations are sent directly from the Donor's wallet to the Campaign Owner's wallet via the blockchain network — GiveGetFunds has no access to, control over, or ability to reverse any such transaction. All cryptocurrency transactions are final and irreversible by nature of blockchain technology. Once confirmed on the blockchain, a donation cannot be reversed, refunded, or recovered under any circumstances, including but not limited to:

• Accidental donations
• Fraudulent campaigns
• Technical errors
• Disputes with Campaign Owners

By proceeding with a cryptocurrency donation, you explicitly acknowledge and accept that the transaction is final and non-refundable.

EU Consumer Notice: Donations made through GiveGetFunds constitute voluntary gifts and are therefore exempt from the 14-day withdrawal right provided under EU Consumer Rights Directive 2011/83/EU. By completing a donation, you explicitly acknowledge that you are making a voluntary gift and waive any applicable withdrawal rights.

7. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free service
• Security or freedom from viruses or harmful components

GiveGetFunds makes no warranty that the Platform will meet your requirements or that results obtained from the use of the Platform will be accurate or reliable.

We do NOT proactively verify:

• The accuracy of Campaign information prior to publication
• The identity of Campaign Owners prior to publication
• How donated funds are used by Campaign Owners
• The legitimacy of Campaigns prior to publication

However, GiveGetFunds reserves the right to investigate any Campaign upon receiving a report or complaint, and to take appropriate action including suspension or removal of the Campaign.

We do NOT guarantee:

• That Campaigns will raise funds or achieve their stated goals
• That the Platform will be available at all times or error-free
• Campaign outcomes or results of any kind
• The security of the Platform against unauthorized access or cyberattacks
• Continuous, uninterrupted access to the Platform
• The accuracy or completeness of any content on the Platform

8. Limitation of Liability

[COMPANY_NAME] SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, punitive, or consequential damages of any kind, including but not limited to emotional distress, loss of enjoyment, or reputational harm, even if GiveGetFunds has been advised of the possibility of such damages.
• Any loss of profits, revenue, data, business opportunities, or goodwill, whether direct or indirect, arising from the use of or inability to use the Platform or any Campaign listed thereon, regardless of the cause of action.
• Any fraudulent, misleading, or illegal activity conducted by Campaign Owners or any third party on the Platform, including but not limited to false representations, misuse of donated funds, or any criminal activity. GiveGetFunds shall not be liable for any losses suffered by Donors as a result of such activity, provided that GiveGetFunds acts in good faith upon receiving reports of such activity.
• Any disputes, claims, or disagreements arising between Donors and Campaign Owners, including but not limited to disputes regarding the use of donated funds, disagreements over Campaign representations or outcomes, and personal disputes or conflicts between users. GiveGetFunds is not obligated to mediate, arbitrate, or intervene in any dispute between users, and any such dispute shall be resolved solely between the parties involved.
• Any errors, failures, delays, or interruptions caused by third-party payment providers including but not limited to PayPal, Stripe, or cryptocurrency networks, including failed or delayed transactions, incorrect amounts processed, account freezes or restrictions imposed by payment providers, changes in payment provider fees or policies, and blockchain network congestion or failures. GiveGetFunds has no control over third-party payment providers and shall not be liable for any losses resulting from their actions, decisions, or technical failures.

Maximum Liability: To the fullest extent permitted by applicable law, GiveGetFunds' total cumulative liability to you for any claims arising from or related to these Terms or your use of the Platform shall not exceed the greater of: (a) the total platform service fees paid by you in the twelve (12) months immediately preceding the date of the claim, or (b) One Hundred US Dollars (USD $100). This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.

EU Consumer Notice: Nothing in these Terms limits or excludes GiveGetFunds' liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation by GiveGetFunds; or any liability that cannot be excluded under applicable EU consumer protection laws. This limitation applies to the fullest extent permitted by Belgian and EU law.

9. Prohibited Activities

You agree NOT to:

• Use the Platform for any purpose that violates applicable local, national, or international laws or regulations, including but not limited to anti-money laundering laws, counter-terrorism financing regulations, and data protection laws.
• Impersonate any person, organization, or entity, including creating a false identity on the Platform, using another person's name, photo, or personal information without their consent, misrepresenting your affiliation with any organization or charity, or creating multiple accounts to circumvent Platform restrictions.
• Post, publish, or share any false, misleading, or fraudulent content, including but not limited to false campaign stories or fabricated personal circumstances, misleading photos or videos not related to the campaign, exaggerated or unverifiable funding goals, false testimonials or endorsements, or misrepresentation of how donated funds will be used.
• Harass, abuse, threaten, or intimidate any user or third party on the Platform, including sending threatening or offensive messages, engaging in cyberbullying or targeted harassment, publishing private or personal information of others without their consent (doxxing), or making discriminatory remarks based on race, religion, gender, nationality, or any other personal characteristic.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt the Platform or its infrastructure, including hacking, phishing, or any unauthorized access attempts, introducing viruses, malware, or any malicious code, conducting denial-of-service (DDoS) attacks, scraping or harvesting Platform data without authorization, or circumventing security measures or authentication systems.
• Infringe, misappropriate, or violate any intellectual property rights of GiveGetFunds or any third party, including uploading copyrighted photos, videos, or content without proper authorization, using registered trademarks or logos without permission, copying or reproducing Platform content without prior written consent from GiveGetFunds, or claiming ownership of content that belongs to others.
• Create, participate in, or facilitate any fake, fraudulent, or manipulative Campaign or donation activity, including creating Campaigns for non-existent causes or fabricated emergencies, making or soliciting fake donations to inflate Campaign statistics, operating multiple Campaigns for the same cause to mislead Donors, or coordinating with others to artificially boost a Campaign's visibility or credibility.

10. Account Termination

We may suspend or terminate your account if you:

• Violate any provision of these Terms of Service, whether a single serious violation or repeated minor violations, at GiveGetFunds' sole discretion and without prior notice.
• Engage in, attempt to engage in, or be reasonably suspected of fraudulent activity, including creating false or misleading Campaigns, misappropriating donated funds, providing false identity information, manipulating Platform statistics or metrics, or any activity that may constitute fraud under applicable law.
• Create, post, or distribute any content that violates Section 4 of these Terms or any applicable laws, including but not limited to content that is illegal, harmful, or offensive, designed to deceive or mislead Donors, in violation of third-party intellectual property rights, or related to terrorist financing, money laundering, or any other criminal activity.
• Abuse, threaten, or harm any user, employee, or representative of GiveGetFunds, whether on or off the Platform.

Upon account suspension or termination:

• Access to the Platform will be immediately revoked
• Active Campaigns may be suspended or removed without prior notice
• GiveGetFunds reserves the right to retain records of violations for legal purposes
• Terminated users may not create new accounts without prior written approval from GiveGetFunds

11. Changes to Terms

GiveGetFunds reserves the right to modify, update, or replace any part of these Terms of Service at any time at its sole discretion, including but not limited to changes in fees, policies, or Platform features.

Minor updates will be effective immediately upon posting. For material changes that significantly affect your rights or obligations, GiveGetFunds will provide a minimum of 15 days prior notice through:

• Email notification to your registered email address
• A prominent notice on the Platform

EU Consumer Notice: In compliance with the EU Digital Services Act (DSA), users in the European Union will receive a minimum of 15 days notice before any material changes take effect. During this period, you may terminate your account if you do not agree to the modified Terms by contacting [email protected]

Your continued use of the Platform following the posting of any changes constitutes your acceptance of the revised Terms of Service. If you do not agree to the modified Terms, you must immediately discontinue your use of the Platform and may request account deletion by contacting [email protected]

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Belgium and the European Union, without regard to its conflict of law provisions. This governing law applies regardless of your location or the location of any Campaign or Donor.

Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved as follows:

• Step 1 — Informal Resolution: Parties shall first attempt to resolve the dispute informally by contacting [email protected] and allowing 30 days for resolution.
• Step 2 — Mediation: If informal resolution fails, parties may seek mediation through a mutually agreed mediator in Belgium.
• Step 3 — Courts: Disputes shall be submitted to the competent courts of Belgium.

All proceedings shall be conducted in English or French.

EU Consumer Notice: Nothing in these Terms prevents EU consumers from bringing claims before the competent courts of their country of residence or using the EU Online Dispute Resolution platform at: ec.europa.eu/consumers/odr
